Terms & Conditions

These Terms and Conditions apply to all services, classes, products and gift vouchers provided by Kayleigh McCallum Art & Illustration (“the business”). By making a booking, purchasing a product, commissioning work, or otherwise engaging with the business, the customer agrees to the following terms.

1. Classes

Bookings and Payments

  • All class bookings must be made through the website and paid for in full at the time of booking.

Cancellations by Kayleigh McCallum Art & Illustration

  • If a class must be cancelled by the business, the customer will be offered either a full refund or the option to transfer to another class.

Cancellations by the Customer

  • The business operates a 72-hour cancellation policy.

  • If the customer cancels more than 72 hours before the class, they will be offered either a full refund or a transfer to another class.

  • If cancellation occurs within 72 hours and the place cannot be filled (e.g. from the waiting list), no refund or transfer will be given. The business will make reasonable efforts to fill the space.

2. Private Tuition

Payments

  • Payments for private tuition are valid for 6 months from the date of payment and must be redeemed within this period.

  • If dates have not yet been agreed, the customer must arrange tuition within 6 months. After this period, payments are non-refundable and the business is under no obligation to provide lessons.

  • Payments must only be made following an invoice and confirmation of cost. Payments made outside of this process may not be honoured.

Cancellations by Kayleigh McCallum Art & Illustration

  • If the business cancels a lesson, the customer will be offered an alternative date or a full refund.

Cancellations by the Customer

  • The business operates a 48-hour cancellation policy.

  • If the customer cancels more than 48 hours before the agreed lesson, they will be offered either a rearrangement or a refund.

  • If cancellation occurs within 48 hours, no refund or transfer will be offered. If the business is able to fill the slot, the customer will not be charged and lesson will be rearranged.

  • The business may, rarely on occasion, need to reschedule agreed lessons with at least 48 hours’ notice.

3. Commissions

Payments

  • For commissions under £250, full payment is required at the time of commissioning.

  • For commissions over £250, a 50% non-refundable payment is required at the time of commissioning, with the remaining 50% due on completion.

  • Additional scope or changes to the agreed work will be charged on completion. The full fee will always be agreed with the customer before additional work begins.

  • All payments must be made within 10 working days of invoicing.

  • If payment is not received within 10 working days after completion of the event, the business reserves the rights to charge additional interest on the payment.

Refunds and Ownership

  • Commissions are non-refundable.

  • Ownership of the final commissioned work passes to the customer only once full payment has been received.

  • The intellectual property rights to all artwork remain with Kayleigh McCallum Art & Illustration unless otherwise agreed in writing.

Timescales and Process

  • Estimated timescales will be outlined at the start of the project. The business will make every effort to deliver on time but cannot be held responsible for delays caused by additional scope or unforeseen circumstances.

  • The business is committed to transparency throughout the process and will keep the customer updated at all stages.

4. External Services (e.g. Private Teaching, Illustration at Events, or Other Hired Work)

Payments

  • For jobs under £250, full payment is required at the time of commissioning.

  • For jobs over £250, a 50% non-refundable payment is required at the time of commissioning, with the remaining 50% due on completion.

  • Additional scope or changes to the agreed work will be charged on completion. The full fee will always be agreed with the customer before additional work begins.

  • All payments must be made within 10 working days of invoicing and at least 72 hours before the event commences or the business will not be liable to show and will not offer a refund.

  • If the final payment is not received within 10 working days after completion of the event, the business reserves the rights to charge additional interest on the payment.

Cancellations

  • If the business cancels, the customer will be offered an alternative date or a full refund.

  • If the customer cancels more than 72 hours before the agreed service, they will be offered either a rearrangement or a refund.

  • If cancellation occurs within 72 hours, no refund or transfer will be offered.

5. Gift Vouchers

  • Gift vouchers are valid for 6 months from the date of purchase unless otherwise stated.

  • Christmas gift vouchers purchased from November 2025 will be valid until June 2026.

  • Vouchers can be redeemed against any product or service available on the website using the code provided.

  • Gift vouchers are non-refundable

  • Vouchers may also be redeemed by contacting the business directly at hello@kayleighmccallum.com.

6. Prints, Books and Artwork

Orders and Payment

  • All orders for prints, books, and original artwork must be paid in full at the time of purchase.

Delivery

  • Delivery times may vary depending on stock availability and destination. Customers will be notified of any significant delays.

  • Risk of loss or damage passes to the customer once the items have been delivered.

Returns and Refunds

  • If an item arrives damaged or defective, the customer must notify the business within 7 days of receipt with photographic evidence, and a replacement or refund will be offered.

  • Returns for non-damaged items are only accepted at the discretion of the business. Customers are responsible for return postage unless otherwise agreed.

  • Custom or personalised items (including commissioned artwork) are non-refundable.

Intellectual Property

  • All artwork, prints, and designs remain the intellectual property of Kayleigh McCallum Art & Illustration.

  • Purchase of artwork does not grant the customer rights to reproduce, copy, or distribute the work in any form without prior written permission.

7. General

  • All terms and conditions are available at all times on the website.

  • The business reserves the right to amend these terms at any time. Any updates will be published on the website.

  • These terms are governed by the laws of Scotland, and any disputes will be subject to the jurisdiction of the Scottish courts.
